These Terms and Conditions ("Terms") govern the provision of independent vehicle purchasing advice by AutoMuse ProAdvice ("we", "us", "our") to the client ("you", "your").
By engaging our services, you agree to these Terms.
2. Nature of Services
2.1 We provide independent advice and recommendations regarding the purchase of new or used motor vehicles in New Zealand.
2.2 Our services may include:
Needs analysis and consultation
Vehicle shortlisting and comparisons
Market pricing guidance
Dealer introductions
Negotiation assistance
Review of vehicle specifications and features
2.3 We do not:
Sell vehicles
Act as a licensed motor vehicle trader (unless separately disclosed)
Provide mechanical inspections
Provide legal or financial advice
3. Independent Advice
3.1 We act independently unless otherwise disclosed in writing.
3.2 If we receive a referral fee, commission, or other benefit from a dealer or third party, this will be disclosed to you in advance.
4. Fees and Payment
4.1 Fees will be agreed in writing before services commence.
4.2 Fees may be structured as:
Fixed fee
Hourly rate
Success-based fee
Retainer
4.3 All fees are in New Zealand Dollars (NZD) and are inclusive of GST (specify).
4.4 Payment terms are [1/7] days unless otherwise agreed.
4.5 We reserve the right to suspend services if payment is not received.
5. No Guarantee of Outcome
5.1 We provide professional advice based on experience and available information.
5.2 We do not guarantee:
A specific purchase price
Availability of a particular vehicle
Future resale value
Mechanical condition of a vehicle
5.3 Final purchasing decisions remain entirely your responsibility.
6. Vehicle Condition and Inspections
6.1 We strongly recommend independent mechanical inspections for used vehicles.
6.2 We are not liable for defects, faults, or issues discovered after purchase.
7. Limitation of Liability
7.1 To the maximum extent permitted by New Zealand law, our liability is limited to the amount you paid for our services.
7.2 Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 where applicable.
7.3 We are not liable for:
Dealer conduct
Manufacturer defects
Insurance outcomes
Delays outside our control
8. Consumer Guarantees Act
8.1 If you are acquiring our services for personal use, the Consumer Guarantees Act 1993 applies.
8.2 If you are acquiring our services for business purposes, you agree that the Consumer Guarantees Act does not apply to the extent permitted by law.
9. Fair Trading
We comply with the Fair Trading Act 1986 and will not engage in misleading or deceptive conduct.
10. Privacy
10.1 We collect personal information necessary to provide our services.
10.2 Information may include:
Name and contact details
Budget and financial preferences
Vehicle preferences
Trade-in information
10.3 Your information will be handled in accordance with the Privacy Act 2020.
10.4 We will not share your personal information with third parties without consent, except where required by law.
11. Confidentiality
We will treat your personal and financial information as confidential, except where disclosure is required to provide the service or by law.
12. Cancellation
12.1 You may cancel services in writing.
12.2 You may be charged for work completed up to the cancellation date.
12.3 If we cancel services, any unused prepaid fees will be refunded.
13. Intellectual Property
Any written reports, comparisons, or documentation we produce remain our intellectual property unless otherwise agreed.
14. Dispute Resolution
14.1 In the event of a dispute, both parties agree to first attempt to resolve the matter in good faith.
14.2 If unresolved, the dispute may be referred to mediation in New Zealand before court proceedings are commenced.
15. Governing Law
These Terms are governed by the laws of New Zealand.
